Demolitions

If you intend to demolish a building or part of a building you may need to submit a Demolition Notice| to our Building Control Team, adjoining owners and service providers (electric, gas and water).

We must be notified at least six weeks before demolition is due to start. This allows us time to service a ‘Counter Notice’ with our requirements, if necessary.

A Counter Notice sets out any conditions that must be complied with during the course of demolition. It may include:

  • Health and Safety requirements for the public and workers on site;
  • measures for the protection of neighbouring properties;
  • provisions to limit the amount of dust, noise etc created on site;
  • restrictions on working hours;
  • limitations regarding the burning of waste on site;
  • conditions for the removal of waste.

Failure to notify us or to comply with any requirements stated in a Counter Notice can result in prosecution.

Commencement of demolition work

Demolition work should only start after either:

  • We have served a Counter Notice; or
  • A period of six weeks has expired since a Demolition Notice was sent; or
  • we’ve confirmed in writing that a Counter Notice will not be served.

Notification of a demolition is NOT required where:

  • buildings have an external size of less than 50m3. (This is less than the average double garage)
  • it relates to extensions on a larger building that consist of an attached conservatory, shed or garage
  • the building is used solely as for agricultural purposes.
  • work relates to an occupied building and it is intended that it should continue to be occupied.

Listed Buildings and Conservation Areas

Any alteration or demolition of a Listed Building requires Listed Building Consent| .The substantial or complete demolition of an unlisted building in a Conservation Area may require Conservation Area consent (link to Conservation Area pages).

Asbestos materials

If materials containing asbestos are found during demolition the Health and Safety Executive| should be notified immediately. Requirements for the safe removal and disposal of asbestos must be followed.

If the skip operator or other contractor is not licensed to transport asbestos based products licence will be required from the Environment Agency|.
